Paliare Roland Success in Cycle Toronto et al. v. Attorney General of Ontario et al., 2025 ONSC 2424.

 

On July 30, 2025, Justice Paul Schabas granted Cycle Toronto’s and the individual applicants, Eva Stanger-Ross’ and Narada Kiondo’s application to prevent Ontario from removing the protected bike lanes on Bloor St, University Ave and Yonge St.

Justice Paul Schabas found that any removal of those protected bike lanes would violate s.7 of the Canadian Charter of Rights and Freedoms because doing so would increase the risk of injury or death to cyclists, while not achieving the legislation’s purported objective of reducing vehicle congestion. Justice Schabas further found that Ontario’s amendment to the legislation in issue following the hearing of the application was a “cynical maneuver” aimed at avoiding judicial scrutiny, and determined that the application was not moot.
