Consumer protection: Talesnik v. MyHeritage Ltd. (Ontario proceeding; national class)

What is the lawsuit about?

 The lawsuit is against MyHeritage Ltd. (“MyHeritage”). The plaintiff was a subscriber to MyHeritage, a genealogy service.

 The plaintiff claims that MyHeritage unlawfully automatically renewed his subscription to MyHeritage, increased the price of his subscription, and failed to permit him to cancel his subscription with a refund. The plaintiff alleges that this conduct was contrary to Israeli consumer protection law, which applied to his use of MyHeritage under standard-form terms of conditions.

 What is the status of the lawsuit?

 The plaintiff started the lawsuit in August 2026 in Toronto on behalf of a proposed class of Canadian resident users of MyHeritage. The plaintiff will be bringing a motion to ask the court to allow the case to proceed as a class action.

 The proposed class is defined as:

 All individuals resident in Canada who subscribed to MyHeritage prior to the “Revision Date”. The Revision Date is the date in 2024 when the Terms and Conditions were changed so that Israeli law no longer applied to the use of MyHeritage.
