Dan Rosenbluth

Dan is an accomplished advocate with a practice focused on commercial disputes, employment law, and public law. He has represented clients successfully in complex applications, arbitrations, and appeals involving issues such as shareholder disputes, commercial insolvencies, and real estate matters.

 

In his employment law practice, Dan advises both individuals and employers on a broad range of matters such as executive dismissals, workplace investigations, and restrictive covenants.

 

As a student at the Queen’s University Faculty of Law, Dan earned course prizes for the highest standing in nine courses, including administrative law, civil procedure, taxation, constitutional law, and legal ethics. During that time, he also served on the editorial board of the Queen’s Law Journal and as a peer tutor.

Representative Work

  • 2177546 Ontario Inc. v. 2177545 Ontario Inc.: As lead counsel, Dan acted in a matter involving unauthorized access of his client’s privileged emails by the opposing party, which is now one of the leading authorities regarding remedies for breach of solicitor-client privilege by a litigant. Paliare Roland obtained an order striking out the respondent’s response to the application, paving the way for an undefended hearing. The Court of Appeal unanimously upheld the decision: 2023 ONSC 5984, aff’d 2023 ONCA 693

  • Sabatino v. Mastrangelo et al., 2021: Successfully secured the complete dismissal of a Commercial List oppression application concerning a closely-held restaurant business (unreported).

  • Intercap Equity Inc. v. Bellman: Jeff Larry and Dan Rosenbluth successfully enforced a personal guarantee in a decision concerning the interpretation of “continuing” guarantees. The decision was upheld on appeal (2022 ONCA 61).

  • Chebib et al. v. Harlos, 2022: Successfully obtained judgment in relation to a disputed valuation process for a parcel of real estate (unreported).

  • 10390160 Canada Ltd et al. v. Casey et al.: Jeff Larry and Dan Rosenbluth successfully resisted a motion for a Mareva injunction on behalf of a real estate development group (2022 ONSC 628).

     

  • Welling v. Doug & Partners Inc.: Successfully moved to strike portions of a statement of claim referencing settlement-privileged communications. The decision is one of the few precedents of its kind in Ontario law

    (2021 ONSC 5064).

  • Alharayeri v. Wilson: Successfully argued a complex garnishment motion relating to a director’s right to indemnity for liability in oppression as lead counsel (2018 ONSC 6309).

  • Dhillon v. Stewart: Successfully argued a summary judgment motion in which he secured approximately $1 million in damages for breach of contract as lead counsel (2018 ONSC 4004).

  • Toronto Star v. AG Ontario: Acted as co-counsel to the Workplace Safety and Insurance Appeals Tribunal responding to a constitutional challenge to the application of privacy legislation to Ontario tribunals. The application was granted in respect of every tribunal except WSIAT (2018 ONSC 2586, 142 O.R. (3d) 266).

  • College of Optometrists of Ontario et al. v. Essilor Group Canada Inc.: Acted as co-counsel to two health regulatory colleges in an application concerning the constitutional applicability of Ontario health care legislation to an online eyewear retailer (2018 ONSC 206) (2019 ONCA 265).
