Linda R. Rothstein B.A., LL.B.

Called to the bar in 1982

 

The Managing Partner of a busy litigation boutique, Ms. Rothstein practices in the areas of civil and administrative litigation with particular expertise in class actions, commercial litigation, professional liability and misconduct, public law, employment and human rights, judicial review and appeals.

She was the City of Toronto’s lead counsel at the Toronto Computer Leasing Inquiry and Commission counsel to the Pediatric Forensic Pathology Inquiry.

In addition to her busy litigation practice, Ms. Rothstein acts as a mediator in civil and commercial litigation and has acted as counsel to boards of directors of many organizations engaged in sensitive workplace investigations.

Ms. Rothstein is a Bencher of the Law Society of Upper Canada, and is a Past President of The Advocates' Society (2005-2006) , having served on its Executive Committee since 2003 and as a Director since 1988. She is a Fellow of the American College of Trial Lawyers.

For many years, Ms. Rothstein has been actively involved in advocacy training: as a part-time member of the Faculty of Law, Osgoode Hall (1989-1994), as a Team Leader and Guest Instructor at the Osgoode Hall Intensive Trial Advocacy Course, and as a Faculty Member in The Advocates' Society Skills Training Programs.

Ms. Rothstein has a wealth of regulatory experience prosecuting and defending a wide range of professionals. She is the co-author of the leading Canadian text on legal malpractice, Lawyers' Professional Liability (Toronto: Butterworths, 1999, 2nd ed.) and “Professional Liability” (ch.9) in D. Lundy G. MacKenzie and M. Newbury, Barristers and Solicitors in Practice, Butterworths, 1998 and a contributor to Archibald & Cochrane (eds.) – National Annual Review on Civil Litigation 2001.

In April 2003, she delivered one of the Law Society of Upper Canada’s Special Lectures entitled “Balancing Probabilities: The overlooked Complexity of the Civil Standard of Proof”. In April 2005 she co-chaired the Law Society of Upper Canada’s Special Lectures on the Modern Law of Damages.

In June 2005, Ms. Rothstein was awarded the Law Society Medal for distinguished service to the profession. In February 2008, she was presented with the "Award of Distinction" by the Toronto Lawyers' Association.

Ms. Rothstein has been selected by the Best Lawyers in Canada (2010) in four litigation specialties: Administrative and Public Law, Bet-the-Company Litigation, Corporate and Commercial Litigation and Labour and Employment Law.
