Massimo (Max)  Starnino B.A. (Hons), LL.B.

Called to the bar in 1998

 

Max Starnino’s principal practice encompasses all aspects of restructuring and insolvency law, including private and court-supervised debt workouts and restructurings, receiverships, bankruptcies, winding-ups, secured transaction and priority disputes, directors’ and officers’ liability, lender liability and shareholder disputes. In that context, he has acted for debtors, secured lenders, bondholders, court officers, directors and officers and majority and minority shareholders of both private and publicly traded corporations.  Recent engagements of note include:

  • representing the Superintendent of Financial Services of Ontario in the restructuring of Nortel Networks Corporation and its subsidiaries;
  • representing certain noteholders opposed to the restructuring of Canada’s Asset Backed Commercial Paper Market; and,
  • representing the United Steelworkers in insolvency proceedings in respect of, among others, Marathon Pulp Inc., Collins & Aikman Automotive Inc. And Hamilton Specialty Bar Corporation.

Mr. Starnino has also represented participants in more generalized civil and commercial litigation, including shareholder and partnership disputes and securities related litigation.  He has also represented brokers and agents in disciplinary proceedings before the Real Estate Council of Ontario.

Mr. Starnino is a former co-editor of the Restructuring chapter of Canadian Forms and Precedents and has spoken and authored a number of articles for publication and for clients.  His most recent article, The Intersection of Labour and Restructuring Law in Ontario: A Survey of the Current Law, was cited and relied upon by the court in the case of Fraser Papers Inc., 2009 CanLll 39776 (Ont. S.C.)  He sits on the executive committee of Ontario Bar Association Insolvency Section, and is a member of the Turnaround Management Association.

Mr. Starnino is a graduate of the Faculty of Law of the University of Toronto and was called to the Ontario Bar in 1998. He has an undergraduate degree (B.A. (Hons.)) in Economics from Concordia University
